Lawyers for a Florida man who killed a pit bull in front of his apartment building have filed a petition seeking eviction from the landlord.
The man, David J. Haney, has been charged with aggravated battery, criminal mischief and criminal damage to property.
In April, the Florida Department of Law Enforcement received a call from the man who told investigators that Haney had been drinking at the time of the dog attack, according to a report.
Handy told the department he had been “over-reacting” and that he believed the dog was attacking him.
Haney has pleaded not guilty.
He has a court date in Broward County.
