In a letter sent to a brookly lawyer who represented a woman who said she was raped by a man in the Brooklyn neighborhood where she lived, a woman says she is “deeply disappointed” with her client’s decision to represent her.
In a letter to New York City’s top legal officer, Sarah Kowalchuk, the lawyer says her client did not act responsibly in representing her, and she is asking that the city “make it clear to all other attorneys who may be representing women in brookeslyn that they will not be representing these women if they continue to represent them.”
“I am deeply disappointed with your decision to have me represent my client in the city where she has lived since 2008, and I do not think that this is the right thing for a lawyer to do, particularly in the face of so much evidence of her failure to uphold the standards of conduct that the profession is supposed to expect of itself,” she wrote in a letter obtained by the Financial Review.
The letter comes amid rising reports of sexual assaults in the borough, which is a predominantly black and Latino neighborhood in Brooklyn.
The borough is grappling with a growing number of reported rapes, including in the summer, which has sparked protests and demands for changes in policing and the city’s criminal justice system.
In an interview, Kowalschuk, who represents several women, said she does not know the woman, who is in her early 20s, by name and has not seen her since her encounter in the neighborhood in August 2016.
She said she spoke to the woman on Monday after the matter was brought to her attention by a friend, who said the woman had reported the attack to police in Brooklyn a month earlier.
The woman told her that she did not report the attack, but did not provide the name of the person who did, KOWALKUSKY said.
She told the woman that she had seen her friend and the other woman at a party in the block where the alleged incident took place.
KOWALSKY said she then called the woman to tell her about the incident and to ask if she would like to have a police report filed.
“I asked her to tell me what she saw, what she heard, and whether she was in the area,” KOWALLOCK told the newspaper.
The woman told KOWallocks she had been drinking with a friend when she heard the party had gotten out of hand.
She said she asked a woman about what she had heard, which was that someone had pulled a knife on her, she said.
The friend told her the woman was screaming and crying and had broken her arm.
The friend said she and the woman went outside and the two women talked for a while, KOWSKY said, but that the woman said she did what she needed to do to get out of there.
“She said that the man then got back in the car and started screaming at her, that he wanted to kill her,” KOWSK said.
After the incident, Kowsk said she had spoken with the woman again, who told her she had asked her friend to call police.
The man later returned and told KOWSKS she had called the police, KWSK said, adding that she said she told the man she was “not going to report him.”
“She told me he was a white supremacist, and that he would kill her, because she had black friends and that she would have to report to the police,” KWSKSK said of the woman.
“He said that she should just leave and go home and stay with her friends, and he would never do that to her again.”
The woman, a former Marine Corps soldier, also told KWSKA that she felt unsafe in the community and that people had told her they would never work with her again, KAWALKSKY said in the letter.
“It is important that I and my client are represented and I hope you will see that we are doing our part to protect our community,” she said, and called on the city to “take action to remove all barriers” between the community, police and the criminal justice process.KOWALKSK has not responded to a request for comment from the Financial Times.
A spokeswoman for the city of Brooklyn said it has been in contact with the attorney and is “actively working to ensure the rights of women and girls are protected.”
The city did not respond to requests for comment about the letter or about the number of women who have reported rape or sexual assault to the NYPD.
Kowalsk, who was appointed to the position in January, said the borough is “not perfect.”
“There are serious issues with our law enforcement system,” she told reporters.
“We need to address these issues.
We need to change our laws, and we need to ensure that our community, including women, feels safe.”
The Brooklyn borough is among
